Mesothelioma Victims Vs Kansas State

Mesothelioma Victims Vs Kansas State: Before delving into the topic, it is important that I attempt to explain in the simplest of terms the horrendous disease named ‘mesothelioma’. It is a type of cancer that develops from the mesothelium; a thin layer that covers many of the interior organs. The cancer is almost always fatal. Why is Kansas state senate making it hard for mesothelioma victims to file lawsuits then?

These patients are already sick and suffering at the hands of a life threatening illness. Their lives should be made as easy as possible rather than throwing hurdles their way!

The use of asbestos in Kansas

Asbestos is heat-resistant and anti-corrosive. Due to these qualities, asbestos was used abundantly during the 1900s for many products and purposes. It was used in agriculture, food processing, oil & natural gas, aviation industry, etc.

Hurdles to filing a lawsuit?

The hard fact that has made it difficult to file lawsuits for mesothelioma patients is the imposition of a statute of limitations. This basically means that a time period has been imposed. Only within this time period can lawsuits be claimed.

For a person who has been diagnosed with mesothelioma, he/she must file a claim within two years of diagnosis. Direct family members who wish to file a wrongful death claim must also do so within two years of the date of passing away.

Contradiction?

The local senators who have pushed and supported the bill claim that the aim is to not only make it easier, but also faster for the mesothelioma patients and other victims of asbestos exposure to receive compensation following filing of lawsuits. The reality is far from the sunny picture painted!

There have been well-founded arguments that the bill has made it even more difficult for mesothelioma patients to file lawsuits due to the requirement for them to pursue a tedious and lengthy investigation prior to filing of the lawsuit.

When everyone is aware of the dreadful disease and all that it entails, then why is Kansas state senate making it hard for mesothelioma victims to file lawsuits? They obviously have the support of the very companies against which claims are being filed!
