Eagles in legal battle with “Hotel California” owners for using name without permission

Eagles in legal battle with “Hotel California” owners for using name without permission: This week came with a rough surprise for the Los Angeles based  rock band ‘The Eagles’, as they discovered that a hotel is conning people by wrongly associating their super hit album ‘Hotel California’ with the name of their own hotel.

‘Hotel California’ is the fifth studio album of The Eagles and the one which will always be discussed in the history of Rock n Roll music. Not just the band’s most bestselling album but it also made its place at number 37 on Rolling Stone’s list of ‘The 500 Greatest Albums of All Time.’ An estimated 32 million copies were sold worldwide but that’s almost 10 million fewer copies, if compared to their previous album ‘The greatest hits (1971-1975)’.

According to details, band members of Eagles have filed a case against the hotel with alleging that they are taking advantage of the name of their album to profit their own business by lying to the tourists and lodgers. The management of hotel boldly tells visitors that this hotel is associated with the band. This shenanigan doesn’t seem to stop here as the hotel is also offering tee shirts and other goodies with fake signs of the band.

The hotel management, to create a more convincing effect on their visitors, play songs of the band all day long on their stereo systems,  which falsely represents this hotel as an official side business of The Eagles. Many people who visited the hotel also reviewed the place by congratulating the band on their official Facebook page, to which, the band had no response but to scratch their heads in confusion.

According to the band, owners of Hotel California have already applied to register itself with U.S patent and trademark.

“Defendants lead consumers to believe that the Todos Santos Hotel is associated with the Eagles and, among other things, served as the inspiration for the lyrics in ‘Hotel California,’ which is false,” the complaint said.

The hotel in question originally opened its doors to the public back in 1950, with the name Todos Santos, then, it went through multiple name changes before settling on the final name ‘Hotel California’ when a Canadian couple, John and Debbie Stewart, bought it in 2001.

The song Hotel California in the album of the same name by Eagles, holds its fame for a long guitar outro which features Don Felder and Joe Walsh. Lyrics were sung by Don Henley.

In an interview with CBS News last year, Henley said the song is about “a journey from innocence to experience. It’s not really about California; it’s about America.”

Charley Walters, while discussing album ‘Hotel California’, once wrote, ‘Hotel California showcases both the best and worst tendencies of Los Angeles situated rock, but more strikingly its lyrics present a convincing and unflattering portrait of the milieu itself. Don Henley, handling five of the eight vocal tracks, expresses well the weary disgust of a victim (or observer) of the region’s luxurious excess.’

The case is Eagles Ltd v Hotel California Baja LLC et al, U.S. District Court, Central District of California, No. 17-03276.
